The plan is intended to assure donors that their support will be used responsibly and that project progress, expenditures, challenges, and measurable outcomes will be communicated in a timely and professional manner.

Community Habitat Programs Inc. retains exclusive legal control and discretion over all contributions received. Donations will be used only to further our charitable purposes. Donor preferences will be honored when practicable; however, unless expressly accepted as restricted in writing, all designations are nonbinding. ORGANIZATIONAL CONTROL OVER CONTRIBUTIONS Community Habitat Programs Inc. informs contributors that the organization’s Board of Directors retains ultimate authority, discretion, and control over all contributions received and will use those contributions only for purposes consistent with the organization’s tax-exempt charitable purposes. This information is communicated to contributors through one or more of the following methods: 1.Statements appearing on the organization’s website and online donation page; 2.Language included in mailed and emailed fundraising solicitations; 3.Donation forms, pledge forms, campaign materials, grant proposals, and sponsorship documents; 4.Written gift agreements for significant, restricted, noncash, or real-property contributions; 5.Donation acknowledgments and receipts; 6.Direct communications with donors, foundations, businesses, and government grantmakers; and 7.Policies and terms governing fundraising campaigns and third-party donation platforms. The organization’s standard donor communication explains that contributions become assets of Community Habitat Programs Inc. upon acceptance and are subject to the organization’s exclusive legal control. The Board of Directors determines how contributions will be administered and spent in furtherance of the organization’s charitable mission. For unrestricted contributions, the organization may use the funds for any program, project, operating expense, administrative need, or other activity that is consistent with its exempt purposes. A donor may express a preference that a contribution support a particular program, property, project, community, or charitable activity. Unless Community Habitat Programs Inc. expressly accepts that preference as a legally binding restriction in writing, the donor’s designation will be treated as a nonbinding recommendation. The organization will make reasonable efforts to honor the donor’s stated preference but will retain ultimate authority and discretion over the contribution. When Community Habitat Programs Inc. expressly accepts a restricted contribution, the organization will use the contribution in accordance with the accepted charitable restriction. The organization will not accept restrictions that: 1.Are inconsistent with its exempt purposes; 2.Provide an improper private benefit to the donor or another designated individual; 3.Allow a donor to control the organization’s Board, personnel, contractors, or day-to-day operations; 4.Require the organization to engage in unlawful or impracticable activities; or 5.Jeopardize the organization’s tax-exempt status. If an accepted restricted purpose becomes impossible, unlawful, impracticable, unnecessary, or inconsistent with the organization’s charitable mission, Community Habitat Programs Inc. may contact the donor to request permission to modify the restriction. When appropriate, the organization may also seek modification under applicable charitable-trust or nonprofit law. Contributors are not permitted to retain ownership of donated funds, demand repayment of an unconditional completed contribution, select private beneficiaries, direct payments to specific individuals, or receive any share of the organization’s earnings or assets. Community Habitat Programs Inc. maintains records of donor restrictions and separately accounts for restricted contributions when appropriate. Its Board of Directors oversees the acceptance, administration, and use of contributions to ensure that all donated funds are used for charitable purposes. STANDARD LANGUAGE PROVIDED TO CONTRIBUTORS The following statement may appear on the organization’s donation pages, solicitation materials, and donation forms: “Community Habitat Programs Inc. retains exclusive legal control and discretion over all contributions received. Contributions will be used only to further the organization’s charitable and tax-exempt purposes. Donor preferences for a particular program or project will be considered and honored when practicable, but unless the organization expressly accepts a contribution as restricted in writing, such preferences are nonbinding and the Board of Directors retains authority to redirect the contribution to another charitable use consistent with the organization’s mission.” LANGUAGE FOR PROJECT-SPECIFIC CAMPAIGNS For fundraising campaigns associated with a specific property or project, the organization may use the following language: “Contributions to this campaign are intended to support the identified project and related charitable activities. Community Habitat Programs Inc. will make reasonable efforts to use contributions for that purpose. The organization retains ultimate authority and discretion over all donated funds. If the project is completed, fully funded, delayed, modified, discontinued, or becomes impracticable, excess or unused contributions may be applied to another housing, rehabilitation, neighborhood-revitalization, or charitable program consistent with the organization’s exempt purposes.” LANGUAGE FOR DONATION ACKNOWLEDGMENTS Donation acknowledgments may include the following statement: “Thank you for your contribution to Community Habitat Programs Inc. Your gift has been accepted subject to the organization’s exclusive legal control and will be used to advance its charitable purposes. Any designation accepted by the organization will be administered in accordance with the applicable written gift terms and governing law.” LANGUAGE FOR FOUNDATION OR GOVERNMENT GRANTS For grants subject to an approved grant agreement, the organization may state: “Community Habitat Programs Inc. will retain responsibility for the administration of the grant and will exercise full control over the expenditure of grant funds. Funds will be used only for the charitable purposes and approved activities described in the grant agreement. The organization will maintain appropriate financial records and provide required program and financial reports.” BOARD OVERSIGHT The Board of Directors, or an authorized committee acting under Board-approved policies, will: 1.Review material donor restrictions before acceptance; 2.Reject restrictions inconsistent with the organization’s charitable purposes; 3.Ensure that contributions remain under the organization’s control; 4.Monitor the use of restricted funds; 5.Approve material changes in the use of donated funds when legally permitted; 6.Prevent donors or related persons from receiving impermissible private benefits; and 7.Document significant restricted gifts and related decisions in the organization’s records.
